High court, Justice K Chandru said on 1st august
"Police as on date has no legal right to prevent a health spa being operated by any citizen of this country, even if it (massage) is done by persons belonging to the opposite sex. As pointed out by the Supreme Court, majoritarian impulses rooted in moralistic tradition cannot impinge upon individual autonomy... In the absence of a law, the only argument of the state was based upon moral and ethical grounds."So I also thought on it for a while and finally I saw two sides of spinning coin.
The Spa side: Logically Speaking spa must be a place where you just go and relax and someone will massage you (may be of opposite sex), and when you come out you must feel as virginal as ever.
This is a prerequisite that opposite sex must not indulge in any thing other that massage which can be considered as crass and also that the person being massaged is comfortable with opposite sex.
This practice is common in many countries and is even not ethically wrong until it is following ethical and virtuous rules.
The Other side: But as we all know that things are not actually veracious as they appear, there are many blemishes in current laws and thus some ill-bred men fulfill their cravings by using spa for some kind of obscenity and it is quiet true that spa's are being used for some sort of sexual activities.
Police just want to do the work which is necessary to eradicate such kind of disgusting places, but still massage from opposite sex is not a crime and not even ethically wrong until it is only a paid massage rather than some thing more than that.

This maybe an aggresive comment but the author should finally declare which side he's convinced with, as that is what the whole funda is about... taking a decision.

virginal means "fresh" by literal meaning :P
ReplyDeleteand this post is neutral because We can not be decisive on such issues because this is a sensitive one and either of them can be correct or wrong it depends on the ground realities because what logic says may not be true on ground level
hmm... maybe some1 should come up with an achromatic idea. :P
